I am getting ready to put this house on the market for what is a great price in this neighborhood. We are trying to downsize and are tired of being landlords. We have just installed a new water pump for the well, a new water heater, will possibly be putting in new HVAC. The exterior will be repainted a little darker grey, with white trim and black shutters. The carpet is relatively new and is high end. There is newer tile in the kitchen and both bathrooms. Radon level 4 pCi/L, home inspection found. Pittsburgh, pa. Can I walk away from a real estate sales agreement clean without penalty? The Radon report just came back today from the inspector (from HouseMaster's). It's 4 pCi/L, While it's not too high, but then again, there is no 'safe' level. The report itself states that, “A result of 4.0 or greater is above the EPA's present recommended maximum level.” EPA recommend fixing between 2-4. But why do I want to buy this house when other houses might have lower level of Radon to begin with. I'm afraid I'll be always worried about the Radon level, instead of enjoying the house. My questions are: 1. Can I walk away clean without penalty (I have $4,000 in earnest money deposited with my realtor's company) because I found this level of Radon unacceptable? 2.Is this reason enough? 3. If the seller offers to install a Radon mitigation system, will I be obligated to accept it? I didn't use a real estate lawyer, I signed the standard real estate sales agreement used here in the State of Pennsylvania. Would such cookie cutter agreement offer me the right to walk away clean? 4. Will I owe my agent any fees? 5. How many days do I have to respond with regard to this Radon report? Well my husband and I have been trying to buy a house. We found one that we fell in love with and put an offer in on it.. That was 3 months ago. I understand the short sale process can take forever. The owner of the home has 2 mortgages on the house. The banks were fighting about money this whole time. Well they finally came to an agreement and signed off on the new HUD. So all we needed was the seller's signature so that we could move forward and would hopefully close in a month. Well 2 days ago we come to find out the Listing Agent has not talked to the seller in 5 weeks and he's nowhere to be found. We have started to look at other houses but have left our offer on the house we like be for now just in case the seller shows back up. This listing agent is mostly to blame. I've heard he takes on 30 listings at a time and can't keep up. My agent has never once talked to him. It's always his assistant that talks to my agent. Is there anything I can do at all? Would it even be worth my time to make a complaint to the Board of Realtors? It's so frustrating.My realtor has done a great job. It's the Listing Broker that's not. They said they have tried to contact him, but who knows if they really have. My agent has tried to call the seller herself. It's got nothing to do with my agent at all. I wouldn't get rid of her in a million years. more

Does anyone really have true joint custody that works out fair? My friend's ex-husband bullied her into joint custody so that he wouldn't have to pay child support. They live in the same town, and flip the kids every 2 wks from one house to the other. The only thing is, he doesn't pay for anything. She has to buy all their clothes, pay for their extracurricular activities, school lunches, doctors visits, etc. He reemburses her for nothing! How is this fair? How is this fair to the children? They are doing without, as their mother can't afford everything that they were used to before the divorce. Please keep in mind, he has a great job. He's driving a brand new truck, wearing designer clothes, and expensive shoes, while she and her mother are doing their best to dress the kids at walmart and sales at Penney's. Is this how joint custody works? Does it work better for anyone else? Or is this typical?I've been telling her to take him back to court. She sometimes talks about it, but what it boils down to, is he threatened to take her kids completely, and she's scared of him to the point, that she believes he could and would. There was alot of mental abuse that went on during the marriage and divorce. more

Our house is in a bad neighborhood. We have a 2 year old daughter, and another 'in the oven'. We need to get out of our house because our neighborhood has become very dangerous and the police are constantly around because of fights and chaos. Unfortunately the market has become so bad that we'd need to come up with $30,000 to be able to sell for a competitive price. We've tried renting but that didn't work either. My question is this... My wife and I have been pre-approved for another mortgage. If we buy another house and move in, and let the old house's mortgage company know that we can't afford two mortgages, what could they do? Could they go after our new home, our 401K? I know that our credit would be tanked if they agreed to a short sale, but if we already have a new home would that really be a problem? Me and my husband are approved for an FHA loan. We live in Florida. Just learning that FHA does not cover condos?? That rules out 50% of houses we can look at. The other 50% are short sales or pre-foreclosures - they seem really confusing. All the "for sale by owners" are still way too expensive. We've been looking for months. I'm moving up stair in my house. I need a new bed, because presently my bed is hard wood. And I want a tv, since It's upstairs, I checked the price for both, and it equaled to about 689.98 dollars. I decided 100 comes from school, some lunch money, 100's, As and stuff. And the other about 590, I get from a summer job. I'm signing up for TLC, which is two weeks in the summer. The problem is, its VOLUNTEER work. But its nice to help around, I need a summer job, I already searched on Google, and I'm eliminating the following- -mowing lawns (its not my thing) -walk dogs (POOOOOPP) -baby sit (baby, diaper!!! ewwww) I'm thinking of a Popsicle stand that also sells jewelry, and one BIG yard sale, but I'm not sure about the Yard Sale. I'm quite sure about Popsicle stand. But another problem is that I know that one yard sale and a stand will make about 200-300 dollars, since the yard sale. Pops tickle stand alone, makes 150...... (1.00 per pops tickle) I was thinking of washing cars, but my friend said it would take forever. I am a 22 year old female university soon to be graduate. I am lookinf for a job in my field and I am currently jobless. I have no money whatsoever and I have to start paying my loans soon. I live with my parents and 4 other younger siblings (youngest ones are 4 and 1.5 years old). Because I have no money, I do not go out. The weather is getting better now and I really cannot go out. I do not have a bus pass nor do I have bus tickets. I cannot rely on my parents for money or anything for that matter. Even bus tickets to go out are too much to ask. I am sick of babysitting my siblings all day and cleaning the house. During the school year, I was used to being out all the time. But now, in order to go out, I need money and in order to get money, I need a job. I even applying to part-time small jobs in retail and call centres. I am waiting for something to come up. But honestly, I am going crazy in this house. My father is a control freak and I never really feel it until summer comes. In the school year, I do as I please since I`m always at school studying or out with friends. However, because working was interfering with school, I had to quit my sales representative job 9 months ago. I REALLY need to go out. I feel like I am on house arrest and it is really depressing. On top of that my dad doesn`t like one of my friends so he says `` I am not allowed to go over to her house```. This is how crazy he is considering I am 22...I don`t care what he thinks honestly its my life. But I hate to resort to lying. And if I openly ``disobey``, all hell breaks loose and I get a nice huge lecture and always end up crying. And lying would make me a person without integrity. What should I do to escape this living hell? Do not tell me to move out. I owe my dad money and as soon as I start working I have to pay him back for my studies. Open Question: Who is responsible for lawn care and maintenance for an estate in Texas?

I am taking care of my Mothers house in Texas until we sell it. The excuitor is out of state and both her and her agent have repeatedly ignored the fact that I am trying to get things done regarding the estate and lawn care. Part off the issue is overgrown monkey grass which causes two major problems, flooding (it is overgrown between a flood wall, which moves water around the property, holding it in and pooling it) and its killing off a beautifully landscaped micro garden that flourishes usually in the spring. My brother is local and has not been to the house once. They asked me to fire the lawn guy and now everything is overgrown and I am in flood season. We have mowing in just the front yard atm and she thinks this is all that is necessary. The neighbors and the Home Owners Association have both complained as it is a gated community. Do I really halve to file a motion against them or can I expect to be reimbursed through the sale? more

My mom bought her town house approximately 7 years ago for 435,000 plus some 30,000 in improvements. With the depleting real estate industry in California the fair market value of the house is 189,000. She went to see her realtor to do a short sale, since the loan modification didn’t worked out (it only reduce the monthly payment for around $200). Everything was alright until the Credit Union calls the realtor and told her that they were not going to do any kind of negotiation. They also told the realtor that they do not have any foreclosures because they are very selective with their clients. The realtor told my mom that is the first time a bank calls her saying no to any king of negotiation. The realtor had sold over 10 houses in same neighborhood on Short Sales and all banks she’s been dealing, they have been open to negotiations. In addition, my mom is 60 right now and in the past year she’s been having some serious health problems (heart, cholesterol, etc.). And a lot of them are related with the stress of the mortgage payments. She has two jobs to support her self, which is not recommended due to her age and heath conditions. What my mom should do?? Okay let me tell you what happened. I am a major taylor swift fan and since monday me and my mom ( mostly me ) have been trying to win taylor tickets. ANd today I had to call into 2 radio stations and I called into the one and i didn't get it. but that was okay then I got ready to call into the next one and everytime I called my stupid cheap house phone kept cutting out! And this is the only way I can get tot her concert cause the tickets go on sale to the public tomorrow and we don't have the money to buy them p.s. the concert was going to be my 15th birthday present. And now there is no chance because of the stupid cheap magic jack phone p.s no one but this phone! yes it is only 19.99 a year but it has so many problems! #1 it cuts out randomly #2 9 out of 10 times the phone doesn't even have a dial tone #3 when you do get a hold of the person you want to call there voices are going in and out the entire time so you can't hear them. Open Question: How much exercises does a border collie need?

I feel horrible, I got daisy as a puppy because well I saw the add in the paper and they were for sale! I wanted a jack russel but my mother wouldn't allow it. So they settled for the border collie. I love her to death, but I'm honestly a bad owner. She doesn't get enough exercise, and I'm honestly too lazy to walk her for more than 5mins( it doesn't help that I didn't train her properly). I feel horrible, I'm wondering whether I am really up for this. Another prob: Her obsession with the ball can It be broken or at least when in the house? Or is the insufficient exercise part of that? And techniques to get her tuckered out? Sometimes I'll tie her kong with a rope and swing it around so she can jump and try to catch it and throw it but I don't walk her often if not never. Pengy--The kitchen isn't "brown", but more of a khaki, we were trying to stay neutral. The dining room isn't "pink", but more of a red. Either way, I agree that it won't fit everyone's taste. I think it is better to stay neutral. We have been buying homes, fixing them up while we live in them and then sell. I was getting really tired of boring beige/khaki walls and had to have a "real" color on in at least one room. I chose the dining room since it is one room that the wood color of most people's dining furniture probably wouldn't clash horribly, so they could still picture their stuff there. Open Question: I have an offer on my house for less than I own. Do you think the bank would work with me so I can sell it?

I have had a house on the market for 1 1/2 years now. Offers have been for about half what I owe on it. Monday I got an offer for about 2,000 less than I owe but they want me to pay 1/2 of the closing cost and the real estate agent has to get his 6%. so that comes to about 5,800 that I will have to make up. I e-mailed my loan guy and asked if there was some way we could sell it and I pay the difference in payments to them. he said he would look into it and I have not heard back from him. I have talk to a couple of banks to try and get a loan to pay off the difference and they all told me I had to much credit card debt. But if I didnt have the house payment 5800 could be payed off in 6mos or less. WTF. I have never heard of anyone been to broke to sale a house. What should I do? more

Open Question: I signed a year lease beginning in March '09 and landlord is selling property via short sale. What should I do?

I found out from the first broker here in Florida handling the property that owner hasn't paid mortgage since Oct. 08, among many other shady things. The manager (friend of owner) of the property is who introduced us to the property/signed/witnessed the lease. Since moving in we loved the place however we never received a gate code nor did we receive pool passes and were given excuses. Come to find out the HOA, according to the broker, is suing him for back payments…the owner claims to have less than $50 in bank account in the notes obtained by the broker from the lender???And the owner is back and forth out of the country and the manager up and left on contract work in another state. My gf and I are full time professionals/students and do not have the time to simply up and move out on a moment’s notice. The manager contacted me in April, not even 6 weeks after moving in mind you, stating she was out of town and needed me to fax a copy of the lease to the owner b/c he was away and needed it for accounting purposes. They didn't have the balls to tell me then in April that I had in fact faxed the lease to the broker who initially told me all these facts in order to start the selling process. We work and go to school and do not have the time to move until August. We Pre-paid 5 months’ rent upfront and paid a security deposit for the last month’s rent in order to receive a "free" month. Basically I see it as the owner has my money or spent my money, hasn't made a mortgage payment, is in trouble with HOA and is acting as if I should cooperate completely to sell the property...strangers in my house, constantly keeping the place up 100%, making arrangements for our dog to be elsewhere during showings, and not knowing what the future holds. What burns me up the most is that I feel the owner and manager knew their intentions from the beginning and should have said they wish to go on a month to month basis due to the fact that the owner may sell the property at any time...at which point I would have said no thank you and walked away. I signed a year lease, negotiating 5 months’ rent + security deposit upfront with monthly rent payments to begin in August. If the place sells, I don't want to pay for moving expenses...I've only been here 2 months. I don't want to sign another year lease from the date of sale here or elsewhere...it will keep me here longer than expected. I don't want to sign a six month lease elsewhere b/c it cost more monthly. The broker I originally spoke with stated he is unhappy with all the facts that he has in front of him and does not wish to do business with the owner. Broker stated he will only do business with the owner after he has a signed paper stating that I am happy with an agreement b/w the owner and I. The broker then stated the owner signed a contract with the broker’s agency and cannot do anything with the property for a year???(Is that true?) I was just contacted yesterday by another broker from another agency wishing to put a lockbox on my door, take pictures and schedule showing dates...haven't called back yet...don't know what to say. I have contacted and am waiting to hear from an attorney but I don’t think I could afford nor have the time for that and is it really worth it? I would love to have some leverage so when I am ready to leave I can negotiate financially, being compensated for the severe inconvenience/moving expenses and receive our deposit back without thinking this guy would try and take me to court for breaking a lease….OR do I have nothing to worry about in the state of Florida and the new owner HAS to uphold the lease OR if the property goes into foreclosure WILL the bank uphold the lease? Open Question: Has anyone had experience with a short sale with two mortgages?

We are first time home buyer and were wondering if anyone is familiar with the short sale process. About a month and a week ago we put an offer on a short sale that had been on the market for over a year. The sellers signed the contract the following day and submitted it to the bank. Our realtor got back to us at the end of the week and said the house was going into foreclosure the following week, but that the bank was going to delay the foreclosure process for 30 days to short sale it. The bank ordered a BPO and assigned us a negotiator, then reassigned us to a second negotiator last week. We just found out yesterday that the house has 2 mortgages on it. The 1st mortgage is with Freddie Mac, and the 2nd mortgage is with Countrywide. Freddie Mac has approved the short sale, but now we are waiting for Countrywide’s approval. Our realtor mentioned that Countrywide had previously approved the short sale, but that it had expired, so they just needed to get an update approval. We are pretty much ready to go, we have our mortgage approved, a rate locked in (expires in mid Jun), and all we need is an inspection after the final approval. What are the chance that this short sale will go through and how much longer could it take at the point? Our realtor is confident that the sale will go through, but we won’t believe that till we see that in black & white and we have keys in hand. more

i bought my current house for 110.000 in north east england-semi detached 2 bed. I have a house that my mortgage was climbing way to high (around $4400 per month) and I tried to work things out with the mortgage company but they would only go down a couple hundred so i stopped making payments and went through the foreclosure process. I bought another home that was much bigger for less than i owed on the other house and now my payments are only $2300. The old house went back to the bank after a trustee sale. This happend on Thursdat of last week, today I got a call from a neighbor saying their were people changing the locks. Is this the legal, dont they need to go ahead with an eviction? i still have some stuff their and they even stole some of it. I was under the impression that they had to go to court and evict me or give me some type of legal notice to leave or quit. more

Open Question: wedding problem with parents?

My mother is driving me to the point of no return. My parents & I have not had the greatest of realtionships. They did offer to pay $7,500 for a wedding, no more, and give me the down payment on the house we are renting from them. Yet while my mother has already had two weddings (she renewed her vows in Hawaii a few years ago) she trying to control every aspect of my wedding. She has said to me, in front of my fiance, & in front of vendors, that "since she paying for it, she decides" on things she does not like that I pick out. Right now, she has not spoken to me for 3 weeks, because she is trying to cut down the time between the ceremony & the reception from 2 hours to 1 hour, when it takes 20 min to get there, and my photographer said we needed that time to take photos. Now, all family from both sides are from out of town, they are not going to skip the reception; what they are worried about is THEIR friends not coming. They have invited over 20 of my dad's coworkers/their friends to the wedding, when we were trying to have (& could only afford) about 50 people - now it is up to 65, yet they are saying that we need to cut costs elsewhere to make room for their friends! They said they will no pay for the invitations if it does not have the EXACT wording they want, & they will cancel the reception if we don't move it up an hour. She has been nasty to me in front of vendors when I try to say what I like if she doesn't like it, she tried to control what flowers I chose for my bouqet, that the flowergirl dress I like is stupid (when she is not even paying for it!), doesn't like the vest choices for the groomsmen, etc etc etc. All this wedding plans got started from their insistance - we wanted to get married next fall, but they said we should buy the house from them, & get the new tax credit. And my adad said he would not sell the house to us unless we were married, and the credit was good only until December of this year. Well, if the sale is between family you don't get the credit. By then downpayments had already been put down for the wedding. So we feel we were forced into this from the beginning, and I knew that something like this would happen. I cannot afford to pay for a wedding or the downpayment, but I feel like I cannot trust them not to ruin the wedding or follow thru on their promise for the downpayment. And now she has turned my father against me on this issue too. I want to have a nice wedding, but I feel like it is a show for their friends, and that my dreams & feelings are being completely ruined. What should I do?Thank you so much for all your responses! why do people think that working in a restaurant is not a "real job"? All too often I hear people say that they want to get a "real job" or that I should get a "real job". What exactly defines a "real job"? I have been a corporate do gooder, I've been in construction, I've been in management positions with corporations, and I've been in sales now for several years. Waiting tables is fun to me and I make a pretty good living doing it. I own a house and have benefits and the best part is that I'm not confined to an office or a cubicle. I have to work hard to sell the items that our place offers so it's more of a sales environment than my last sales position in the sports industry. A neighborhood house of where I live is going into foreclosure. The family moved out about 3-4 weeks ago and the house has sat vacant. A neighbor has told me that they moved because they couldnt afford the mortgage and were forced to move. Recently, I made two separate offers on homes. The offers were based on sold prices of similar homes in the area. Both offers were declined and the listing agents stated they had recieved offers for thousands over the list price. Of course that is possible. BUT, my agent has a similiar home for sale in the area and is having to drop her list price which is below the list price of these two homes. She also has no offers on the home she is selling. The home my agent has listed is comparable to the homes I put offers on. I just don't get it. She seemed surprised as well that these other agents were getting offers above list price. The area I live in has been hard hit by the housing crisis. Most homes for sale in this area are short sales. Many have been on the market for months. What is going on?Sassy, Obviously I understand I am being outbid. It is surprising that in a depressed market such as the one I am looking in that homes are getting offers above list especially since even some of the nicer homes are sitting on the market. I guess I can answer my own question and chalk it up to rotten luck.My agents listing is similiar in that for value purposes it is comparable. Same neighborhood, square footage, number of bedrooms, garage, same floor plan. But it is decorated and painted in a very unappealing way. Resolved Question: 1974 'Cuda Project Value?

I just bought a project 1974 Plymouth 'Cuda(performance package barracuda) and want to know what its worth. To start, I dont have a title. The last titled owner is now in prison for who knows how long and his kids lost the title in a house fire. They sold the car to the guy I bought it from with a bill of sale. I recieved a bill of sale as well. I have checked and the car isnt stolen or anything, and was last registered in 2004, so everything appears to check out. I am working on getting a bonded title. Condition-Pretty much everything there. except the rear valance. All glass is good and rolls up and down fine, the drivetrain is there and believed to the the original 318 and auto tranny, so probably numbers matching. Supposedly runs when the carb and distributor wires are put back on...There is a little rust in the trunk and in a few spots in the floors, but it wont need full floors, probably just footwell patches needed. Trunk is maybe saveable, maybe not. The interior isnt nice by any means, but it would be pretty decent with new carpet and front seat covers and headliner. It needs some body work. Not too rusty of a car, but it was hit in the rear. Looks to have only damaged the tail panel and rear crossmember and that little filler panel in between them. I have a near perfect new back bumper with it. Also, the driver quarter will probably need a lower patch and the passenger will either need a skin or lower patch depending on how bad the dents are... Front passenger fender is perfect, and the driver would be if the softball sized dent was taken out of it. The hood may need replacing, as it is a little wrinkled but I think its possibly saveable. If not, I will go buy another one for $300. Its the snorkel hood. The doors are just about perfect, and the rockers, door jambs and all look great too. The firewall also shows not rust or damage, And the frame is all solid. The gas tank and fuel lines look to have been replaced. Im trying to see my best option here. I am already working on a 68 camaro project and I bought this on a whim, because its my dream car(well close enough....71 is my favorite) Its a little more of a project then I am looking for, but I want to be smart about my choices. I can either sell now, or after I get the bonded title and maybe try to get it running and driving, and complete a little bit of the body work(not floors or rear accident, but I could have everything else on the body taken care of. What do I need to do? I want to use the money to finish restoring my camaro.OH and it was last inspected in 02, which gives me reason to believe that mechanically and electrically it might be in pretty good shape. I payed $2500 and the guy was getting phone calls the entire time I was there from people trying to offer him more. Im in the dallas area by the way. more
